First Settlers in Lade Vale: Frank and Catherine Lawless

Is this the house that Frank built? Remains of a substantial granite block house on land once owned by the first settlers in Lade Vale, Frank and Catherine Lawless.  It may well have been built by Frank when the family took up their circa 1826 land grant. While we cannot be absolutely certain this is his work, there can be no doubt it is just the sort of house a skilled builder/bricklayer such as Frank would have constructed to settle his family in.

Frank and Catherine Lawless  – The Lade Vale Years

The Story So Far

This is the second chapter in our look at early colonial settlers Frank and Catherine Lawless written by their 3rd great granddaughter, Carmel Peek, in association with GDHS. At the end of our last episode:
  • Bricklayer Frank [as he was commonly called rather than by his formal given name Francis] had been transported to Sydney from Ireland in 1809 following his conviction for highway robbery;
  • He compounded his failings and misfortunes in late 1810 when condemned to the gallows for forging and uttering;
  • Happily this sentence was commuted only four days later.
  • Frank married currency lass Catherine Kearns, daughter of the first registered publican in NSW, in January 1816;
  • Through hard work and competence, Frank rose from being a convict work gang bricklayer to become a self taught architect and builder, acknowledged as a notable contributor to the early architecture of Sydney as well as being a meat producer and publican;
  • His conditional pardon in March 1819 was confirmed in November 1821;
  • We left him in July 1824, doubtless delighted that Governor Macquarie had granted him temporary occupancy of 4000 acres on the Wollondilly.

What Happened at Wollondilly?

Governor Macquarie’s large but temporary grant of land in what is now the Macarthur region of SW Sydney seems never to have been confirmed. Perhaps it was always intended to be a short term occupancy. But it is a good bet that Frank’s transition to land baron was interrupted by the “new broom” reforms instituted after Macquarie was recalled to England.

Macquarie’s successor, Major General Sir Thomas Makdougall Brisbane, found a chaotic land grants situation when he took office. Lands were occupied without proper legal title, people took up properties on the basis of undocumented promises and boundary disputes were rife. Brisbane concentrated on clearing the surveying backlog and tightened up the eligibility criteria for grants so that land was occupied only by people with the inclination and capacity to use it productively. He also began to sell crown land rather than giving free grants. Frank had demonstrated a capacity to be a successful meat producer and may well have had some capital but, nevertheless, could still have been adversely affected by this new administrative regime.

Brisbane also had clear riding instructions from the Secretary of State for the Colonies based on the Bigge report commissioned into Macquarie’s management of the colony. Commissioner Bigge could not see the benefits of Macquarie’s enlightened and successful policies towards emancipists (former convicts).  He condemned Macquarie’s public building works as extravagant and wasteful. Emancipist Frank, as we know, owed his success in the colony in large part to these now out of favour practices. It is not likely he would be at the front of the queue under the post Macquarie regime.

The Lawless Move to Lade Vale

Happily, all was not lost. On or before 15 October 1826 Frank received a Land Grant from Governor Darling, possession of which was required by 6 February 1827. We know this in part from a public notice in the The Sydney Gazette in June 1841:
Case 986 – Francis Lawless, of Yass, Representative of. 
Twelve hundred and eighty acres, county of King, parish unnamed, near Mount Mundoonan; bounded on the north by a line east 160 chains; on the east by line south 80 chains; on the south by line west 160 chains; on the south by a line west 160 chains, being upon the eastern branch of Jerrawa Creek. 
This land was located on an order of Governor Darling’s, dated 15 October, 1826 in favour of Francis Lawless, who, it is supposed, is deceased. His representatives are to show to whom a deed of grant should now issue. The description was inserted in the Gazette notice of 1 August 1839.
Frank (not deceased!) must have responded to this notice. The formal transfer of Yellongloa to Francis Lawliss Snr was effected on 15 December 1834 – almost eight years after Governor Darling’s order in Frank’s favour. Why the delay? We cannot say with certainty but a dispute between Darling and Surveyor-General Mitchell, which resulted in Mitchell transferring all his staff from marking out settlers’ blocks to trigonometrical survey work, is a likely contributing factor.

We don’t know how long the family retained their Pitt St property or when they moved to their new holding. A Sydney real estate advertisement for a neighbouring property shows Frank still owned the Pitt St premises in November 1830. It was not uncommon for intending land owners to take up occupation in advance of any approvals and formalities – the Claytons of Baltinglass being just one local example. Perhaps Frank and his son [also Francis aka Frank] and assigned convicts first occupied the grant initially before Catherine and the other children left Sydney to take up country life.

Life in Lade Vale

Frank’s property was one of the earliest land grants in the Gunning district and the first for the locality we know today as Lade Vale. Surveyor Robert Dixon’s map above shows there were no other holdings in the district in 1837, the closest neighbour being many miles from the Lawless property.

One of the nearest neighbours shown is Simeon Lord. His grant in the Jerrawa district was called “Howlong”, a variant or corruption of today’s locality name Oolong – both thought to mean “place of native companions or brolgas”. Lord, an early emancipist entrepreneur brought, held and sold many properties, so much so that a contemporary said of him that “Mr Lord knows not what he owns”. He never set foot on this holding.

Life would have been a struggle for the Lawless family and other settlers in this newly established farming area beyond the mountains. The township of Gunning had not been established in those early days and contact with neighbours and the wider outside world would have been rare.

Frank had a number of convict labourers and servants assigned to him over the years. For instance, in January 1836 he was assigned “one farm servant and one farm labourer”. Assigned convicts were known to escape from time to time as evidenced by the size of the lists of ‘wanted escapees’ often appearing in the Sydney Gazette. There are no records we can find of any of Frank’s workers fleeing his service in Lade Vale although, in Sydney in 1823, a “J Kearns, govt. servt. to Mr Francis Lawless” was being sought by authorities for having absconded.

The following report in the Sydney Monitor and Commercial Gazette in March 1840 shows that, as in all remote areas, neighbours rally around and support each other in times of need:-
Gunning: Extract of a Letter from Gunning 
I have now to inform you that a short time ago, Mr Knight had a stack of wheat burned to the ground, and it is suspected had been maliciously set fire to by persons at present unknown; be that as it may, about a week ago, police apprehended a man and a woman on suspicion of having set fire to the stack of wheat alluded to. Mr Knight, of course, had to attend the court at Goulburn against those persons and, during his absence, three men, disguised with crape on their faces, forcibly entered his building, and robbed it of every valuable article they could carry away. 
On Sunday last the Chief Constable of Yass reached Gunning and took two men (supposed to be two men assigned to Mr Savage) into custody on suspicion of having committed the robbery. Messrs Grosvenor, Lawless and Best went out with Mr Knight to search for the property, in the adjoining ranges, and succeeded in finding part.
We do not know anything more about this case but it is one worth further research. Malicious burning of grain and crops is often associated with sectarian uprisings in Ireland and luddites in England. Here, it certainly speaks of serious discontent on the part of at least a few, possibly involuntary, locals. 

What’s in a Name? Yellangalo, Frank and Lawless.

The Dixon 1837 map identifies Frank’s farm by the owner’s name but the family called the property ‘Yellonglar’. There are also other spelling variants of this name on official documents of the time – Yellangla, Yellongloa; Yellongler and Yellanglo. From here on we will go with Yellangalo which is the spelling used for part of original property today.

A wool stencil which we believe comes from the time when Frank Whittaker of nearby “Berrebangalo” owned the property showing the name “Yellangalla”. Today’s Yellangalo was once assimilated into Berrebangalo until being hived off as a separate property again and then later further sub-divided. 

Whatever variant we favour, the meaning of the name is not known to us yet. Perhaps Frank and Catherine knew the word from their time in Sydney or the Wollondilly district. They may also have learned this was a local aboriginal word and adopted it.

Frank

In part 1 of this story we referred to Frank by his formal name of Francis. However, he was more widely known to his contemporaries as Frank and, now that we know him better, we prefer to call him Frank unless quoting official documents.

Lawless

Around the time the family moved to Lade Vale they began to spell their surname as Lawliss rather than Lawless. For example, when his daughter Ann married George Reynolds in 1840 her surname was spelt in the new way on the marriage certificate.

Why the change? We cannot escape the conclusion that they wanted to erase any reference to Frank’s convict past. If so, they were not at all unusual for their time. Many freed convicts changed their names and assumed new identities in a quest for respectability. Indeed, it is only in the past few decades that a convict past has become something in which to take pride rather than a cause of embarrassment.


Right: Charles Darwin, the renowned naturalist and leading developer of evolutionary theory, visited the colony in 1836.  On seeing it was founded largely on convicts such as Frank he predicted “It can hardly fail to deteriorate”. 

How wrong the great man was. The skills, character, resilience and adaptability of people like Frank and Catherine flourished in the new society created in Australia – in a way that would not have been possible in their homelands.

If they came back today, Frank and Catherine could feel nothing but pride and satisfaction in seeing the lives lived by their many descendants and Frank’s contribution to our built heritage legacy. [Picture Wikipedia Commons]

The Farm Changes Hands

A notice in The Goulburn Herald and County of Argyle Advertiser on 19 February 1853 shows the property was taken over by Robert Bayley around this time. Public Notice
The undersigned having rented from the proprietor the farm known as YELLONGLA, formerly Lawliss’s, hereby cautions all persons from trespassing with sheep or other stock on the said farm, or on the adjacent crown lands held by him under yearly lease from the crown.Parties are further cautioned not to drive cattle off the said lands, without first acquainting the undersigned and bringing cattle to his yard.All persons found trespassing as above, after this notice, will be prosecuted. 
ROBERT BAYLEY
In 1884 the property was advertised for sale by auction following Frank’s death on 28 December 1874 at his son John’s property ‘ Erindale’. At the time of his death Frank was 88 years old and his occupation was described as ‘Bricklayer’ There is no mention of his wife Catherine having pre deceased him on the death certificate which is not unusual. The certificate states there were 2 males and 1 female living; 1 male and 2 females deceased.

The November 1884 property advertisement in the Goulburn Evening and Penny Post stated:
Situated in the parish of Mundoonan, Country of King, distant about 6 miles from the Gunning Railway Station 
Finlay and Co have received instructions from Mr John Tighe of Sydney, to sell by auction at the rooms, Belmore-Square on Thursday 27th November at 11 O’clock sharp 
The above estate known as Lawliss’s Farm comprising:- 
1280 acres in a rectangular block, extending two miles in an easterly and westerly direction with a depth of one mile north and south; originally granted by the Crown to Francis Lawliss. 
The Jerrawa Creek flows through the area for upwards of a mile of its course, and on one portion of the property there is a never failing spring, which supplies a water-hole in the creek near the eastern boundary line. During the severest season this waterhole has been a constant source of water supply. 
There are two cleared areas of land on the grant, which was originally under cultivation. On the east and west boundary lines are the fences of adjoining selectors; on the north and south sides there are thousands of acres of Crown Lands immediately adjoining the property for sale which circumstances, in view of the new Land Act to come into operation at the beginning of the year, enhance the property to a considerable degree. 
For upwards of 40 year, sheep have been folded and yarded on the land. The Auctioneers have therefore every confidence in recommending it as eminently fitted for grazing or agricultural purposes and the fact of such large tracks of Crown lands adjoining it on the north and south renders it an investment of such a character as is not often offered to the public. 
A plan of the land may be seen at the office of the auctioneers. 
Intending purchases will obtain an accurate idea of the position and surrounding of the Grant on inspecting the map of the parish of Mundoonan at the Crown Lands office, Gunning.
The history of the property from the beginning of the post Lawliss period until our times is a another story. There is still a Yellangalo today but between 1884 and now the original holding has been amalgamated with a neighbouring farm, later born again and recently sub divided. Its history illustrates economic, agricultural and social changes across the entire district and beyond which are best covered separately.

Death of Catherine Lawless

An extensive search of all available records has failed to determine when Catherine died. It seems likely this happened between 1836 and 1841 because: 
  1. Catherine is identified as the wife of Francis Lawless in both the 1825 Australian Convict Muster and the 1828 Census. In 1825 her children were Francis (8), Ann (5) and Elizabeth (2.9yrs). John was born that same year (1825) but, as he not listed in the Muster records, his birth was likely to have been later that year.
  2. In the 1841 Census, Francis Lawless is recorded as the head of family living at Yellongala County of King. There were 8 people listed for this residence, six of them male and two female. Both females were recorded as being under 14 years old. Frank himself can be identified as the male aged between 45 and 60. John (born in 1825) is the male recorded as being person aged between 14 and less than 2. Francis jnr (born 1819) was recorded elsewhere in the Census as living at ‘Temorama’ in the District of Murrumbidgee.
  3. It appears then that neither Catherine nor her daughter Ann was living at Yellongala at the time of the 1841 Census. Ann had married George Reynolds in 1840 and was living elsewhere. Catherine is not shown as living with George and Ann at that time.
  4. Catherine’s 6th and last child, William Henry, was born in 1836 so he would have been 5 years old in 1841. Perhaps the two children under 14 years were actually male and female and not 2 females?
  5. William Henry’s 1836 baptismal record shows his two siblings, Ann and John, being his sponsors at his baptism ceremony. This may have been held in St Mary’s Cathedral Sydney but it is more probable that the baptism was undertaken by Father Therry of St Mary’s on one of his visits to country areas.
  6. When Eliza Lawliss married Peter Best on the 22nd November 1841 a newspaper article reported “Eliza Lawliss of Yellonglar married Peter Best – youngest daughter of Mr F Lawliss of Yellonglar…”
From all of the above we can narrow down Catherine’s death down to between 1836 (birth of William) and 1841 (Census). Perhaps she died soon after the birth of William and may have been buried on the family property. If so, there is no known visible evidence of her grave in the area today.

Attentive readers of part 1 of this story will remember that Frank and Catherine were wed by a Church of England minister in Sydney in 1816. At that time it was not possible for members of the colony’s considerable Roman Catholic population to be married in their own church because Governor King, alarmed by the Castle Hill riot and fearing further Fenian uprisings, had withdrawn the right of the only lay minister to officiate. Fathers Therry and Philip Connolly arrived from London in 1820.

At the time Francis Lawliss was transported to Sydney his records have his family name as Lawless. All muster reports and records of his marriage to Catherine Kearns and the Baptism records have the family name as Lawless.
At some point in time the family name became Lawliss. The death certificate for Francis and other members of the family are all spelt Lawliss.

  2. marcella victoria best married william patrick morphy born 1866 in braidwood nsw,, his reported death in 1913 was actually his father of the same name,buried in gunning nsw,, william patrick senior was born in 1836 in armagh ireland. at this stage i cannot find the death of william patrick junior, he was reported in sydney newspapers on the death of his brother as "" living in west australia "" he had been in prison for 3 years & on release was divorced from marcella victoria, perhaps his leave to west australia was to hide the shame ? if any body can assist in finding him it would be appreciated as i have searched for 10 years . he is my great great grandfather,, my father donald john morphy 1933 - 1990 was adopted by his mothers family who changed his name to parker after the death of his mother florence elizabeth parker who was married to john edward morphy , one of the 8 sons of colin william roy morphy 1890 - 1960
